1. Agreement to Terms
By using ForTheirEncore.com (the “Service”), you agree to these Terms of Use and any other policies or procedures published on this website. If you do not agree to these Terms, you must stop using the Service immediately. These Terms form a legally binding agreement between you and Encore Digital Services Ltd (the “Company”), a company registered in England and Wales with company number 15777337. The Service allows users to create and maintain online memorial pages dedicated to individuals who have passed away. By using the Service, you confirm that you are creating or contributing to a memorial page in good faith as a friend, relative, or person with a legitimate connection to the deceased.

2. User Content and Intellectual Property
2a. Ownership
You retain ownership of all content you submit to the Service (“User Content”), including photos, messages, tributes, music, videos, and other materials posted to a memorial page.
2b. License to Publish
By submitting User Content, you grant the Company a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and publish that content on the Service for the purpose of operating, maintaining, and promoting the memorial page. This licence remains in effect for as long as the content is hosted on the Service.
2c. Third-Party Content
You warrant that:
• you have the right to upload or share the content you submit;
• the content does not infringe copyright, privacy, or other legal rights;
• the content is respectful and appropriate for a memorial setting.
You agree to indemnify the Company against claims arising from copyright infringement or other legal violations relating to your User Content. The Company may remove content that appears to violate intellectual property rights or applicable laws. For users in the United States, the Company will comply with the Digital Millennium Copyright Act (DMCA) takedown procedures where applicable.
2d. Marketing Use
You grant Encore Digital Services Ltd the right to use publicly available elements of memorial pages (for example page layouts, page designs, or anonymised excerpts of tributes) for marketing, promotional, or educational purposes unless you opt out through your account settings.

3. Data Protection and Privacy
3a. Data Ownership
You retain ownership of the personal data you submit to the Service. By using the Service, you consent to the storage and processing of this information for the purpose of operating and maintaining the memorial page.
3b. GDPR Compliance (UK/EU)
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and applicable data protection laws. You have the right to:
• access your personal data
• correct inaccurate data
• request deletion of your personal data
• restrict or object to processing where applicable.
3c. CCPA Compliance (US)
If you are a resident of California, you may have rights under the California Consumer Privacy Act (CCPA) including the right to request access to or deletion of personal information we hold.
3d. Data Access and Retention
User data and memorial page content will remain available according to the applicable subscription plan. If a subscription ends, the Company may archive, restrict access to, or remove content in accordance with its internal policies.
3e. Data Sale
The Company does not sell personal data. You may request deletion of your personal data at any time, subject to operational or legal requirements.

4. Responsibility for Memorial Pages
4a. Accuracy and Authority
By creating a memorial page, you confirm that:
• the individual being commemorated has passed away
• the content shared is accurate to the best of your knowledge
• you are acting respectfully and in good faith.
4b. Respect for Families
Memorial pages must not contain content that is defamatory, abusive, misleading, or distressing to surviving family members.
The Company reserves the right to review, edit, restrict, or remove content that may cause harm or distress.
4c. Requests from Immediate Family
If an immediate family member of the deceased (including a spouse, civil partner, parent, child, or sibling) reasonably objects to the creation or content of a memorial page, the Company reserves the right to review the request and take appropriate action. Such action may include: • requesting additional information or verification from the user who created the page
• temporarily restricting access to the page
• editing or removing specific content
• transferring administrative control of the page to an appropriate family member
• removing the page entirely.
The Company will act in good faith to balance the interests of contributors, the dignity of the deceased, and the wishes of close family members. The Company’s decision in such matters shall be final.
4d. Verification of Death
The Company reserves the right to request reasonable evidence that the individual commemorated on a memorial page is deceased. Such evidence may include publicly available obituaries, funeral notices, or other appropriate documentation. If reasonable verification cannot be provided within a reasonable timeframe, the Company may suspend or remove the memorial page.

5. Liability
5a. User Responsibility
You are solely responsible for ensuring your content complies with applicable laws, including copyright, defamation, privacy, and data protection laws.
5b. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for:
• the accuracy of User Content
• disputes between users, contributors, or family members
• damages arising from the publication of User Content
• damages arising from external links or third-party content.
5c. Hosting Provider Status
The Service operates as a platform for user-generated content. The Company is not responsible for content posted by users but will respond to valid complaints or legal notices.

6. Payment and Subscription
6a. Subscription Payments
By subscribing to the Service, you agree to pay the applicable fees associated with your subscription plan.
6b. Refunds
Refunds will generally not be provided once the subscription period has started, except where required by law or at the Company’s discretion.
6c. Third-Party Payments
The Company may accept payments from third parties (including friends or relatives) to extend the availability of a memorial page beyond the initial subscription period.
6d. Subscription Extensions and Disputes
If disputes arise regarding the extension or control of a memorial page, the Company reserves the right to suspend changes until the matter is resolved. The Company may consider requests from immediate family members when determining appropriate resolution.

7. Content Moderation and Community Standards
7a. Community Standards
The Service is intended to be a respectful space for remembrance and tribute.
Content that is abusive, malicious, defamatory, misleading, or otherwise inappropriate may be removed.
7b. Moderation
The Company reserves the right to remove or restrict any content that violates these Terms, our Community Standards, or applicable laws. Reports may be submitted to:

The Company’s moderation decisions are final.
7c. Memorialisation or Page Locking
In certain circumstances, including disputes between contributors or requests from verified family members, the Company may designate a memorial page as “memorialised” or “locked.” When a page is memorialised or locked:
• the page may remain visible as a tribute to the deceased • no new content may be added or edited by users • administrative control may be restricted or transferred. This measure may be used to preserve the integrity of the memorial while preventing disputes or inappropriate content.

8. Dispute Resolution
If a dispute arises under these Terms, the parties agree to attempt to resolve the matter through good-faith discussion and internal mediation by contacting: support@formyencore.com
If the dispute cannot be resolved informally, it may be referred to arbitration or the courts of England and Wales, where applicable.

9. Governing Law
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws provide otherwise.

10. Limitation of Service Guarantees
We aim to provide a reliable and respectful memorial service. However, the Service is provided “as is” without guarantees of uninterrupted availability, security, or error-free operation. We are not responsible for the actions or content of other users.

11. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12. Communications with Third Parties
If you provide the contact details of friends, relatives, or other individuals, you confirm that you have their consent to share those details with the Service. Those individuals may opt out of communications at any time.

13. Updates to Terms
The Company may update these Terms from time to time. Updated Terms will be effective upon publication on the Service. Continued use of the Service after updates constitutes acceptance of the revised Terms.
